This presentation will aim to give a top level overview of how recent changes in the legal and political framework for health and safety regulations, impact businesses.
In the last three years, there have been two new acts of parliament which gave senior Directors pause for thought – The Health and Safety Offences) Act 2008 in which imprisonment is now an option for a wider range of offences in both the lower and higher courts and the Corporate Manslaughter (and Corporate Homicide) Act 2007 in which a Company may be liable for unlimited fines and be subject to a publicity order.
With litigation on the increase, a culture of extreme compliance (with the ensuing red tape) could be said to have ensued. The new coalition government has styled itself as taking a more pragmatic view with a report due from Lord Young at the end of the summer which will outline a new agenda for health and safety.
This session will look to explore the implications of this new agenda for senior Directors. What impact does the new environment have on the risk of prosecution and civil liability claims and how can these risks be managed and controlled? Would any change in the legal framework benefit poorly managed companies at the expense of the responsible operators?
THE SPEAKERS

Barbour focuses on bringing business sense to the health and safety agenda and is bringing together for this session, three experienced senior professionals to give Directors a steer in terms of understanding the legal and political framework for health and safety and what this means for businesses in practical terms.
Mark Tyler
Mark Tyler is a Solicitor and Chartered Safety and Health Practitioner, and a partner at Shook Hardy & Bacon International LLP in London (http://www.shb.com/). He is recognised as a leading practitioner in the area of health and safety law in publications such as Legal 500 and Chamber UK.
As well as dealing with many high-profile HSE prosecutions over the years his experience includes the BSE Inquiry, the Southall and Ladbroke Grove rail accident Inquiries, MMR vaccination claims and Legionnaires Disease cases. He has successfully defended a director of a large privately owned company prosecuted personally for health and safety offences, and has been involved in several corporate manslaughter investigations undertaken by the police and the HSE.
Ian Clements
Ian Clements is Managing Director of Quadriga Health and Safety (http://www.healthsafety.co.uk/) and has extensive experience in advising Boards of Directors about Health and Safety. Quadriga provides specialist health and safety consultancy and training to a wide range of clients including Lloyd’s Register, Nuffield Health, Priory Healthcare and Virgin Media.
Ian personally has over 25 years experience in occupational health and safety, gained across a wide range of industries and activities, both in the UK and overseas including heading the health and safety function for Thames Water Plc and Smiths Industries Plc (now Smiths Group).
Derek Allen
Derek Allen became Executive Director of LACORS in March 2002. He was previously Head of Regulatory Services at Thurrock Council; a role which included town planning, environmental health, trading standards and highways enforcement services. He trained as an Environmental Health Officer at the London Borough of Barking and Dagenham where he specialised in food safety and private sector housing.
LACORS has a crucial role to play in supporting and driving improvement and efficiency in the delivery of council regulatory services and is working with, and on behalf of the UK local government associations, along with key local government departments and stakeholders to achieve this.
